Federal Definition of Sexual Harassment

FEDERAL DEFINITION OF SEXUAL HARASSMENT: Federal regulation (34 C.F.R. § 106.30) defines sexual harassments as
- Any quid pro quo harassment by a school’s employee;
- Any unwelcome conduct that a reasonable person would find so severe, pervasive, and objectively offensive that it denies a person equal educational access;
- Sexual assault;
- Dating violence;
- Domestic violence; or
- Stalking.
All other sexual harassment complaints shall be investigated and responded to pursuant to the Uniform Complaint Procedures described on page 9, above.
